1. Acceptance of Terms

By accessing and using BURUDISHA ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily access the materials (information or software) on BURUDISHA for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose, or for any public display (commercial or non-commercial)
• Attempt to decompile or reverse engineer any software contained on BURUDISHA
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password.

4. Content Guidelines

As a user of BURUDISHA, you agree that:

• You will not upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• You will not impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• You will not upload content that infringes on intellectual property rights of others
• You will not engage in any activity that interferes with or disrupts the Platform

5. Artist and Content Creator Terms

Artists and content creators who upload content to BURUDISHA:

• Retain ownership of their original content
• Grant BURUDISHA a non-exclusive, worldwide, royalty-free license to display, distribute, and promote their content on the Platform
• Warrant that they have the necessary rights to upload and share the content
• Agree to our commission structure for marketplace transactions as outlined in the Platform settings

6. E-Commerce and Marketplace (SOKO)

For transactions through our SOKO marketplace:

• All product listings must accurately represent the items being sold
• Sellers are responsible for fulfilling orders in a timely manner
• Payment processing is handled securely through our platform
• Platform commission rates apply to all transactions
• Refund and return policies are determined by individual sellers within our guidelines

7. Intellectual Property

The Platform and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of BURUDISHA and its licensors. The Platform is protected by copyright, trademark, and other laws.

8. Copyright Policy

We respect the intellectual property rights of others. If you believe that any content on our Platform infringes upon your copyright, please contact us with:

• A description of the copyrighted work that you claim has been infringed
• A description of where the material is located on the Platform
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement of accuracy and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

9. Limitation of Liability

In no event shall BURUDISHA, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content

10. Disclaimer

Your use of the Platform is at your sole risk. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. The Platform is provided without warranties of any kind, whether express or implied.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
